Hadith 3321

أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، نا لَيْثٌ، عَنْ مَيْمُونِ بْنِ مِهْرَانَ، أَنَّ عَائِشَةَ، رَضِيَ اللَّهُ عَنْهَا سُئِلَتْ: مَا لِلرَّجُلِ مِنِ امْرَأَتِهِ إِذَا حَاضَتْ؟ قَالَتْ: «مَا فَوْقَ الْإِزَارِ»
Lady Aisha (may Allah be pleased with her) said: "A husband is permitted to have intercourse with a menstruating woman over the izar (lower garment)."
Brief Explanation
Benefit: The athar is weak in its chain (due to Layth ibn Abi Sulaym), but in its content it is a summary of a sahih hadith. This fatwa of Sayyidah Aisha radi Allahu anha is an explanation of the Sunnah of the Prophet sallallahu alayhi wa sallam and holds the status of a juristic principle, that: "Intercourse with a menstruating woman is forbidden, but intimacy over the izar (lower garment) is permissible."
