بَابُ الْمَرْأَةِ يُشْهَدُ عَلَيْهَا بِالزِّنَا ثُمَّ تُوجَدُ بِكْرًاChapter on a woman accused of adultery, then found to be a virgin
Hadith 3298

أَخْبَرَنَا سَعِيدٌ، أنا مُطَرِّفٌ، عَنِ الشَّعْبِيِّ، أَنَّهُ قَالَ فِي امْرَأَةٍ يَشْهَدُ عَلَيْهَا أَرْبَعَةٌ بِالزِّنَا، فَنَظَرَ إِلَيْهَا، فَإِذَا هِيَ بِكْرٌ، فَقَالَ الشَّعْبِيُّ: «مَا كُنْتُ لِأُقِيمَ حَدًّا عَلَى امْرَأَةٍ عَلَيْهَا مِنَ اللَّهِ خَاتَمٌ»
Hazrat Sha'bi (may Allah have mercy on him) said: "If four men bear witness to the adultery of a woman and she turns out to be a virgin, then I would not enforce the hadd (punishment) upon her, for she has the dowry from Allah."
