Hadith 3284

أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا دَاوُدُ، عَنِ الشَّعْبِيِّ، أَنَّ رَسُولَ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ رَدَّ ابْنَتَهُ زَيْنَبَ عَلَى أَبِي الْعَاصِ بْنِ الرَّبِيعِ حَيْثُ أَسْلَمَ بَعْدَ إِسْلَامِ زَيْنَبَ، فَرَدَّهَا عَلَيْهِ بِالنِّكَاحِ الْأَوَّلِ
The Messenger of Allah (peace be upon him) returned Zainab (may Allah be pleased with her) to Abu Al-As bin Rabi’ on the basis of the first marriage after he accepted Islam.

Brief Explanation
Benefit:

✅ 1. Acceptance of Islam does not immediately annul the marriage: If a woman accepts Islam and the husband becomes Muslim later, and if he accepts Islam during the waiting period (‘iddah) or even after it, the marriage can be maintained, provided that: both spouses consent and the woman’s waiting period (‘iddah) has not expired (according to some jurists).

✅ 2. The meaning of "with the first marriage": No new contract was made; rather, the first contract itself was maintained, as if the acceptance of Islam did not annul the marriage, but rather kept it suspended. This narration strengthens the position of the Hanafis and Ahl al-Hadith.
