Hadith 3270

أَخْبَرَنَا سَعِيدٌ، نا سُفْيَانُ، عَنْ عَمْرِو بْنِ دِينَارٍ، سَمِعَ الْحَارِثَ بْنَ عَبْدِ اللَّهِ بْنِ أَبِي رَبِيعَةَ يُخْبِرُ أَبَا الشَّعْثَاءِ، قَالَ: سَأَلَ أَبِي عُمَرَ بْنَ الْخَطَّابِ رَضِيَ اللَّهُ عَنْهُ عَنْ حَدِّ الْأَمَةِ، فَقَالَ عُمَرُ: «إِنَّ الْأَمَةَ نَبَذَتْ فَرْوَتَهَا مِنْ وَرَاءِ الدَّارِ» وَقَالَ سُفْيَانُ مَرَّةً أُخْرَى: مِنْ وَرَاءِ الْجِدَارِ
Sayyiduna Umar (may Allah be pleased with him) said: "When a slave-girl throws her shawl behind the wall, then she is no longer like a free woman."

Fiqhi Points: ❓ Is this a hadd (prescribed punishment) or ta’zir (discretionary punishment)? The answer of Sayyiduna Umar radi Allahu anhu is not a technical fatwa, but rather a juristic commentary. He is indicating that: if a slave-girl commits fornication easily, and she is not like the local, protected women, then she should not be given the concession of a minor offense.
According to some jurists: half the hadd is applied to a slave-girl (as is in the Qur’an: ﴿فَعَلَيْهِنَّ نِصْفُ مَا عَلَى الْمُحْصَنَاتِ﴾), but the scope of ta’zir can be even broader than this—especially if the slave-girl begins to play with the limits (hudud).
