Brief Explanation
Fiqhi Points: ❓ Is this a hadd (prescribed punishment) or ta’zir (discretionary punishment)? The answer of Sayyiduna Umar radi Allahu anhu is not a technical fatwa, but rather a juristic commentary. He is indicating that: if a slave-girl commits fornication easily, and she is not like the local, protected women, then she should not be given the concession of a minor offense.
According to some jurists: half the hadd is applied to a slave-girl (as is in the Qur’an: ﴿فَعَلَيْهِنَّنِصْفُمَاعَلَىالْمُحْصَنَاتِ﴾), but the scope of ta’zir can be even broader than this—especially if the slave-girl begins to play with the limits (hudud).
✅ Conclusion: This athar is authentic in its chain, and in it is found a wise, social commentary from Sayyiduna Umar radi Allahu anhu, the meaning of which is that: if a slave-girl falls into immorality easily, then the hadd can be applied to her. Sayyiduna Umar here connected the severity of the punishment to natural observation and assessed the form of the sin at the level of a crime.
