بَابُ الرَّجُلِ يَكُونُ لَهُ الْأَمَةُ غَيْرُ مَسْلَمَةٍ أَيَحِلُّ لَهُ أَنْ يُصِيبَهَاChapter on a man who has a non-Muslim slave woman—Is it permissible for him to have intercourse with her?
Hadith 3219

أَخْبَرَنَا سَعِيدٌ، نا أَبُو عَوَانَةَ، عَنْ مُوسَى بْنِ أَبِي عَائِشَةَ، قَالَ: سَأَلْتُ مُرَّةَ الْهَمْدَانِيَّ عَنِ الرَّجُلِ يَطَأُ أَمَتَهُ وَهِيَ مَجُوسِيَّةٌ، وَسَأَلْتُ سَعِيدَ بْنَ جُبَيْرٍ فَكَانَ أَشَدَّهُمَا قَوْلًا، وَقَالَ: «إِنْ فَعَلُوا فَمَا هُمْ بِخَيْرٍ مِنْهُنَّ»
Musa bin Abu Aisha (may Allah have mercy on him) said: "I asked Murrah al-Hamdani about a man who has intercourse with his Magian slave woman, and I also asked Sayyiduna Sa'id bin Jubair (may Allah have mercy on him), and both of them were among those who gave a harsh response." Sayyiduna Sa'id bin Jubair (may Allah have mercy on him) said: "If they do such a thing, then they are no better than those slave women."
