Hadith 3194

أَخْبَرَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، أَنَّهُ كَانَ يَقُولُ: «إِذَا لَمْ يَصِلْ إِلَيْهَا أُجِّلَ أَجَلًا سَنَةً، وَرُفِعَ إِلَى السُّلْطَانِ، فَإِنْ وَصَلَ إِلَيْهَا، وَإِلَّا فُرِّقَ بَيْنَهُمَا، وَلَهَا الصَّدَاقُ كَامِلًا، وَعَلَيْهَا الْعِدَّةُ»
Ibrahim Nakha'i (may Allah have mercy on him) used to say: "If a man is unable to have intercourse with his wife, he should be brought before the ruler and given a respite of one year. If he is still unable after that, then separation should be carried out, the woman should receive her full dowry, and she should also observe the waiting period ('iddah)."
