بَابُ مَنْ طَلَّقَ امْرَأَتَهُ مَرِيضًا وَمَنْ يَرِثُهَاChapter on one who divorces his wife while ill and who inherits from her
Hadith 3148

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ فِيمَنْ طَلَّقَ قَبْلَ أَنْ يَدْخُلَ بِهَا وَهُوَ مَرِيضٌ , قَالَ: «لَهَا نِصْفُ الصَّدَاقِ، وَلَا مِيرَاثَ لَهَا، وَلَا عِدَّةَ عَلَيْهَا» قَالَ هُشَيْمٌ: وَبِهِ نَأْخُذُ
It is narrated from Ibrahim (may Allah have mercy on him) that whoever divorces his wife due to illness without consummation, the wife will receive half the dowry; neither is 'iddah obligatory, nor inheritance.
