بَابُ مَنْ طَلَّقَ امْرَأَتَهُ مَرِيضًا وَمَنْ يَرِثُهَاChapter on one who divorces his wife while ill and who inherits from her
Hadith 3146

حَدَّثَنَا سَعِيدٌ قَالَ: نا جَرِيرُ بْنُ عَبْدِ الْحَمِيدِ، عَنِ الْمُغِيرَةِ، عَنِ الْحَارِثِ الْعُكْلِيِّ، فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ تَطْلِيقَتَيْنِ فِي صِحَّتِهِ ثُمَّ مَرِضَ، فَطَلَّقَهَا الثَّالِثَةَ لِلْعِدَّةِ فِي مَرَضِهِ، فَمَاتَ فِي مَرَضِهِ ذَلِكَ، قَالَ: «لَا تَرِثُهُ لِأَنَّهُ لَمْ يَعْتَدِ»
It is narrated from Hazrat Harith Akli (may Allah have mercy on him) that if someone gave two divorces in good health and the third during illness, then died, the woman will not receive inheritance because she was not in the waiting period (iddah).
