بَابُ مَنْ طَلَّقَ امْرَأَتَهُ مَرِيضًا وَمَنْ يَرِثُهَاChapter on one who divorces his wife while ill and who inherits from her
Hadith 3144

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثَلَاثًا، وَهُوَ مَرِيضٌ قَالَ: «لَهَا الْمِيرَاثُ إِنْ مَاتَ وَهِيَ فِي الْعِدَّةِ، فَإِذَا انْقَضَتْ عِدَّتُهَا فَلَا مِيرَاثَ لَهَا» قَالَ هُشَيْمٌ: وَبِهِ نَأْخُذُ
It is narrated from Ibrahim (may Allah have mercy on him) that if a person gives three divorces to his wife during illness, if the wife is still in her waiting period ('iddah), she will inherit; if the waiting period ends, she will not inherit, and this is what we act upon.
