Hadith 3140

حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ أَبِي هَاشِمٍ فِي الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ وَهُوَ مَرِيضٌ إِنْ مَاتَ فِي مَرَضِهِ ذَلِكَ وَرِثَتْهُ، فَقَالَ لَهُ ابْنُ شُبْرُمَةَ: أَرَأَيْتَ إِنِ انْقَضَتِ الْعِدَّةُ أَتَتَزَوَّجُ؟ قَالَ: «نَعَمْ»، قَالَ: فَإِنْ هَذَا مَاتَ، وَمَاتَ الْأَوَّلُ أَتَرِثُ زَوْجَيْنِ؟ قَالَ: " لَا، رَجَعَ إِلَى الْعِدَّةِ قَالَ: «تَرِثُهُ مَا كَانَتْ فِي الْعِدَّةِ»
Abu Hashim says that if a person divorces his wife while he is ill and dies during that illness, the wife will inherit from him. Ibn Shubrumah said: "If her waiting period ('iddah) is completed, can she marry someone else?" He said: "Yes." So he asked: "If the second husband dies, will she inherit from both?" He said: "No, the waiting period is the criterion; as long as she is in the waiting period, she will inherit."
