بَابُ مَنْ طَلَّقَ امْرَأَتَهُ مَرِيضًا وَمَنْ يَرِثُهَاChapter on one who divorces his wife while ill and who inherits from her
Hadith 3139

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، قَالَ: كَانَ فِيمَا جَاءَ بِهِ عُرْوَةُ الْبَارِقِيُّ إِلَى شُرَيْحٍ مِنْ عِنْدِ عُمَرَ رَضِيَ اللَّهُ عَنْهُ أَنَّ: " الْأَصَابِعَ سَوَاءٌ، الْخِنْصَرُ وَالْإِبْهَامُ سَوَاءٌ، وَأَنَّ جُرُوحَ الرِّجَالِ وَالنِّسَاءِ سَوَاءٌ فِي السِّنِّ وَالْمُوضِحَةِ، فَمَا خَلَا فَعَلَى النِّصْفِ، وَإِنَّ فِي عَيْنِ الدَّابَّةِ رُبُعَ ثَمَنِهَا، وَإِنَّ أَحَقَّ أَحْوَالِ الرَّجُلِ أَنْ يَصْدُقَ عَلَيْهَا عِنْدَ مَوْتِهِ فِي وَلَدِهِ إِذَا أَقَرَّ بِهِ، قَالَ مُغِيرَةُ: وَأُنْسِيتُ الْخَامِسَةَ حَتَّى ذَكَّرَنِي عُبَيْدَةُ أَنَّ الرَّجُلَ إِذَا طَلَّقَ امْرَأَتَهُ ثَلَاثًا، وَرِثَتْهُ مَا دَامَتْ فِي الْعِدَّةِ "
It is narrated from Ibrahim (may Allah have mercy on him) that Sayyiduna Umar (may Allah be pleased with him) wrote to Shurayh through Sayyiduna Urwah al-Bariqi (may Allah be pleased with him): "All fingers are equal, the little finger and the thumb are also equal, the blood money for wounds of men and women is equal, except for teeth and bones. If an animal's eye is lost, a quarter of its price should be given. And the best state of a man is that at the time of death he acknowledges his son. And if someone has given his wife three divorces and she is in her waiting period ('iddah), then she is his heir."
