بَابُ مَنْ طَلَّقَ امْرَأَتَهُ مَرِيضًا وَمَنْ يَرِثُهَاChapter on one who divorces his wife while ill and who inherits from her
Hadith 3135

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا عُمَرُ بْنُ أَبِي سَلَمَةَ، عَنْ أَبِيهِ، عَنْ جَدِّهِ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ، أَنَّهُ قَالَ: " لَا تَسْأَلُنِي امْرَأَةٌ مِنْ نِسَائِي الطَّلَاقَ إِلَّا طَلَّقْتُهَا، وَكَانَتْ تُمَاضِرُ بِنْتُ الْأَصْبَغِ أُمُّ أَبِي سَلَمَةَ فِي خُلُقِهَا بَعْضُ مَا فِيهِ، فَسَأَلَتْهُ الطَّلَاقَ وَهُوَ مَرِيضٌ، فَقَالَ لَهَا: «إِذَا حِضْتِ ثُمَّ طَهُرْتِ فَآذِنِينِي» فَآذَنَتْهُ، فَطَلَّقَهَا الْبَتَّةَ، وَمَاتَ فِي مَرَضِهِ ذَلِكَ فَوَرَّثَهَا عُثْمَانُ رَضِيَ اللَّهُ عَنْهُ مِنْهُ بَعْدَ انْقِضَاءِ الْعِدَّةِ
Sayyiduna Abdur Rahman bin Awf (may Allah be pleased with him) said to his wife: "If any of my wives asks for divorce, I will divorce her." When Tamadur bint Asbagh requested a divorce, he said: "Inform me when you become pure from menstruation." Then he divorced her, and after completing her waiting period ('iddah), she participated in the inheritance.
