كتاب الطلاقBook of Divorce
بَابٌ أُمُّ الْوَلَدِ يَكُونُ لَهَا مِنْ سَيِّدِهَا أَوْلَادٌ فَيَمُوتُ عَنْهَا فَتُزَوَّجُ فَتَلِدُ مِنْهُ أَوْلَادًا، ثُمَّ يَمُوتُ بَعْضُ وَلَدِهَا مِنَ السَّيِّدِChapter: Umm al-Walad who has children from her master, then he dies, then she marries and bears children from him, then some of her children from the master die
Hadith 3133

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ، فِي عَبْدٍ مَمْلُوكٍ تَحْتَهُ امْرَأَةٌ حُرَّةٌ، وَلَهُ أَخٌ حُرٌّ، فَمَاتَ أَخُوهُ وَلَمْ يَدَعْ وَارِثًا قَالَ: «يُمْسِكُ الْعَبْدُ عَنِ امْرَأَتِهِ حَتَّى يَعْلَمَ أَبِهَا حَمْلٌ أَوْ لَيْسَ بِهَا؟ فَإِنْ كَانَ بِهَا حَمْلٌ وَرِثَ وَلَدُهَا عَمَّهُ» وَكَانَ يَقُولُ فِي رَجُلٍ عِنْدَهُ امْرَأَةٌ لَهَا وَلَدٌ مِنْ غَيْرِهِ فَمَاتَ وَلَدُهَا ذَاكَ، قَالَ: «يُمْسِكُ الرَّجُلُ عَنِ امْرَأَتِهِ حَتَّى يَعْلَمَ أَبِهَا حَمْلٌ أَمْ لَا؟»
Hasan (may Allah have mercy on him) said: "When a slave marries a free woman and her free brother dies, then the slave should refrain from his wife until it is known whether she is pregnant or not. If she is pregnant, then the child will be the heir of his uncle."
