بَابُ الْأَمَةِ تُبَاعُ وَلَهَا زَوْجٌChapter on a slave woman being sold while she has a husband
Hadith 3121

حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: «إِذَا تَزَوَّجَ الْعَبْدُ بِإِذْنِ سَيِّدِهِ ثُمَّ بَاعَهُ فَإِنَّهُ لَا يُحَالُ بَيْنَهُ وَبَيْنَهَا، وَإِذَا زَوَّجَ الرَّجُلُ أَمَتَهُ ثُمَّ بَاعَهَا، فَإِنَّهُ كَانَ يَرَى بَيْعَهَا طَلَاقَهَا»
Hazrat Saeed bin Musayyib (may Allah have mercy on him) said: "If a slave marries with the permission of his master, then he is sold, his marriage will remain intact. But if someone marries off his slave-girl and then sells her, the selling of the slave-girl was considered her divorce."
