بَابُ مَا يَقَعُ لَهُ إِيلَاءُ الْيَمِينِChapter on when the oath of abstinence takes effect
Hadith 3098

حَدَّثَنَا سَعِيدٌ قَالَ: نا عَتَّابُ بْنُ بَشِيرٍ، قَالَ: أنا خُصَيْفٌ، عَنْ سَعِيدِ بْنِ جُبَيْرٍ، فِي الرَّجُلِ يَغْضَبُ عَلَى امْرَأَتِهِ فَلَا يَقْرَبُهَا أَرْبَعَةَ أَشْهُرٍ، قَالَ: " لَا يَقَعُ عَلَيْهِ إِيلَاءٌ إِلَّا أَنْ يَكُونَ حَلَفَ، أَوْ قَالَ: لَا أَقْرَبُكِ، وَمَا كَانَ مِنْ غَضَبٍ مِنْ قِبَلِ الْمَرْأَةِ فَإِنَّهُ لَا يَقَعُ فِيهِ الْإِيلَاءُ "
It is narrated from Hazrat Saeed bin Jubair (may Allah have mercy on him) that if a person gets angry with his wife and does not go near her for four months, then ila does not take place, unless he swears an oath or clearly says that he will not go near her, and if the anger is from the woman's side, then ila does not take place.
