Brief Explanation
Explanation: There is no explicit statement of hearing (sama‘) from Sayyiduna Ali radi Allahu anhu by Abu Atiyyah al-Asadi, therefore this narration is a mursal (interrupted) report of a Tabi‘i. However, a mursal narration of a Companion is considered valid for juristic reasoning, especially when there is no objectionable content or irregularity in the subject matter, and it is supported by other sources.
The Fatwa of Sayyiduna Ali radi Allahu anhu: The original intention is taken into account: If a husband separates from his wife for a reformative purpose (for example: so that the child may be weaned), then this will not be considered as ila’ (oath of abstention). Ila’ is that which is done out of quarrel, anger, or a motive of enmity.
