Hadith 3033

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ قَالَ: سَأَلْتُ عَنْ رَجُلٍ ظَاهَرَ مِنْ أَمَتِهِ قَالَ: «لَا يَقْرَبْهَا حَتَّى يُكَفِّرَ كَفَّارَةَ الظِّهَارِ» فَقُلْتُ: يُعْتِقُهَا لِلْكَفَّارَةِ؟ قَالَ: «نَعَمْ» قُلْتُ: إِنْ أَرَادَ أَنْ يَتَزَوَّجَهَا بَعْدُ؟ قَالَ: «يَفْعَلُ إِنْ شَاءَ»
Ibrahim (may Allah have mercy on him) said: "If someone pronounces zihar on his slave woman, he must keep away from her until he offers expiation." I asked: "Should he free her as expiation?" He said: "Yes." I said: "Then, if he wishes, can he marry her?" He said: "Yes."
