Hadith 3019

حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، قَالَ: أَخْبَرَنِي مَنْ سَمِعَ الْحَكَمِ، يَقُولُ: " لَا تُجْزِئُ أُمُّ الْوَلَدِ، وَالْمُعْتَقَةُ عَنْ دُبُرٍ فِي كَفَّارَةِ الظِّهَارِ؛ لِأَنَّهُ قَدْ جَرَتْ فِيهِمَا الْعَتَاقَةُ نا سَعِيدٌ، قَالَ هُشَيْمٌ: وَهُوَ الْقَوْلُ
Hazrat Hakam (may Allah have mercy on him) said: "In the expiation of zihar, an umm walad and a woman freed after death are not sufficient, because the ruling of freedom has already been applied to them." Hushaym said: "This is the correct opinion."
