بَابُ مَنْ طَلَّقَ امْرَأَتَهُ وَظَنَّ أَنَّهُ لَهُ رَجْعَةٌChapter on one who divorces his wife thinking he has the right to take her back
Hadith 2971

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُطَرِّفٌ، عَنْ حَمَّادٍ، فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ قَبْلَ أَنْ يَدْخُلَ بِهَا، فَظَنَّ لَهُ عَلَيْهَا رَجْعَةً فَوَاقَعَهَا، قَالَ: «عَلَيْهِ مَهْرٌ وَنِصْفٌ»
Hazrat Hammad (may Allah have mercy on him) said: "If someone divorces after marriage but before consummation, and then, assuming he can take her back, has intercourse with her, then both the full dower and half dower will become obligatory upon him."
