بَابُ الْحُكْمِ فِي امْرَأَةِ الْمَفْقُودِChapter on the ruling regarding the wife of a missing person
Hadith 2933

حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ أَبِي بِشْرٍ، عَنْ عَمْرِو بْنِ هَرِمٍ، عَنْ جَابِرِ بْنِ زَيْدٍ، عَنِ ابْنِ عَبَّاسٍ، وَابْنِ عُمَرَ أَنَّهُمَا قَالَا: «تَنْتَظِرُ امْرَأَةُ الْمَفْقُودِ أَرْبَعَ سِنِينَ» . قَالَ ابْنُ عُمَرَ: «يُنْفَقُ عَلَيْهَا فِي الْأَرْبَعِ سِنِينَ مِنْ مَالَ زَوْجِهَا؛ لِأَنَّهَا حَبَسَتْ نَفْسَهَا عَلَيْهِ» . وَقَالَ ابْنُ عَبَّاسٍ: «إِذًا أَجْحَفَ ذَلِكَ بِالْوَرَثَةِ، وَلَكِنْ تَسْتَدِينُ، فَإِنْ جَاءَ زَوْجُهَا أَخَذَتْ مِنْ مَالِهِ، وَإِنْ غَابَ قَضَتْ مِنْ نَصِيبِهَا مِنَ الْمِيرَاثِ» . وَقَالَا جَمِيعًا: «يُنْفَقُ عَلَيْهَا بَعْدَ الْأَرْبَعِ سِنِينَ أَرْبَعَةَ أَشْهُرٍ وَعَشْرًا مِنْ جَمِيعِ الْمَالِ»
Sayyiduna Ibn Abbas and Sayyiduna Ibn Umar (may Allah be pleased with them both) said: "The wife of a missing husband should wait for four years." Ibn Umar (may Allah be pleased with them both) said: "For four years, she should receive maintenance from the husband's wealth." Ibn Abbas (may Allah be pleased with them both) said: "She should take a loan, and later pay it back from the husband's wealth or inheritance."
