بَابُ الرَّجُلِ يَجْعَلُ أَمْرَ امْرَأَتِهِ بِيَدِهَاChapter on a man giving his wife the right to decide
Hadith 2826

حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَوَانَةَ، عَنْ بَيَانٍ، عَنْ عَامِرٍ، قَالَ: سَأَلَنِي عَبْدُ الْحَمِيدِ عَنِ الْخِيَارِ، فَقُلْتُ: كَانَ عَبْدُ اللَّهِ بْنُ مَسْعُودٍ يَقُولُ: «إِنِ اخْتَارَتْ نَفْسَهَا وَاحِدَةٌ، وَإِنِ اخْتَارَتْ زَوْجَهَا فَلَا شَيْءَ» . قَالَ عَلِيٌّ رَضِيَ اللَّهُ عَنْهُ: «إِنِ اخْتَارَتْ زَوْجَهَا فَواحِدَةٌ، وَهُوَ أَحَقٌّ بِهَا، وَإِنِ اخْتَارَتْ نَفْسَهَا فَوَاحِدَةٌ بَائِنَةٌ»، وَقَالَ زَيْدُ بْنُ ثَابِتٍ: إِنِ اخْتَارَتْ نَفْسَهَا فَثَلَاثٌ " فَقَالَ: اقْضِ فِيهَا بِقَوْلِ عَبْدِ اللَّهِ
Hazrat Amir Sha'bi (may Allah have mercy on him) said: Abdul Hameed asked me about the matter of choice (khiyar). I said: "Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him) used to say: If a woman chooses herself, then one irrevocable divorce (talaq bain) will take place, and if she chooses her husband, then nothing happens." Sayyiduna Ali (may Allah be pleased with him) said: "If the woman chooses her husband, then one divorce and the husband has more right, and if she chooses herself, then one irrevocable divorce." And Sayyiduna Zaid bin Thabit (may Allah be pleased with him) said: "If she chooses herself, then three divorces." So it was said: "Decide in this matter according to the statement of Sayyiduna Abdullah bin Mas'ud (may Allah be pleased with him)."
