بَابُ الرَّجُلِ يَجْعَلُ أَمْرَ امْرَأَتِهِ بِيَدِهَاChapter on a man giving his wife the right to decide
Hadith 2798

حَدَّثَنَا سَعِيدٌ قَالَ: نا حَمَّادُ بْنُ زَيْدٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُمَرَ، عَنْ نَافِعٍ، عَنِ ابْنِ عُمَرَ، قَالَ: " إِذَا جَعَلَ الرَّجُلُ أَمْرَ امْرَأَتِهِ بِيَدِهَا فَطَلَّقَتْ نَفْسَهَا وَاحِدَةً فَهِيَ وَاحِدَةٌ، أَوِ اثْنَتَيْنِ فَثِنْتَيْنِ، أَوْ ثَلَاثًا فَثَلَاثٌ، إِلَّا أَنْ يُنَاكِرَهَا وَيَقُولُ: لَمْ أَجْعَلِ الْأَمْرَ إِلَيْكِ إِلَّا فِي وَاحِدَةٍ فَيَحْلِفُ عَلَى ذَلِكَ، وَإِنْ رَدَّتِ الْأَمْرَ فَلَيْسَ بِشَيْءٍ، وَكَانَ يَقُولُ: الْقَضَاءُ مَا قَضَتْ "
Sayyiduna Ibn Umar (may Allah be pleased with them both) said: "When a man gives his wife the choice and she chooses one divorce, then it will be counted as one divorce; if she chooses two, then two; and if three, then three—unless the man denies it and says that he only gave her the choice of one divorce, then he should swear an oath. And if the woman returns the matter, then nothing (happens)." And he used to say: "The decision is what the woman has made."
