بَابُ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثُمَّ يَقْذِفُهَا فِي عِدَّتِهَاChapter: A man divorces his wife, then accuses her during her waiting period
Hadith 2770

حَدَّثَنَا أَبُو مُعَاوِيَةَ، قَالَ: نا عُمَرُ بْنُ بَشِيرٍ، عَنِ الشَّعْبِيِّ، قَالَ: سُئِلَ عَنْ رَجُلٍ قَذَفَ امْرَأَتَهُ وَهِيَ صَمَّاءُ خَرْسَاءُ، قَالَ: الشَّعْبِيُّ: «لَيْسَ تَسْمَعُ وَلَا تَتَكَلَّمُ فَتُصَدِّقَهُ أَوْ تُكَذِّبَهُ، لَيْسَ بَيْنَهُمَا حَدٌّ وَلَا لِعَانٌ»
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that if a man accuses his deaf and mute wife of adultery, since she cannot confirm nor deny, there is neither the punishment of hadd nor li'an between them.
