بَابُ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثُمَّ يَقْذِفُهَا فِي عِدَّتِهَاChapter: A man divorces his wife, then accuses her during her waiting period
Hadith 2769

حَدَّثَنَا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، نا عَبْدُ الْعَزِيزِ، عَنِ الشَّعْبِيِّ، فِي رَجُلٍ يَقْذِفُ امْرَأَتَهُ فَلَا يَتَرَافَعَانِ إِنَّهُمَا عَلَى نِكَاحِهَا: «لَا يُفَرِّقُ ذَلِكَ بَيْنَهُمَا إِلَّا أَنْ يُلَاعِنَهَا»
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that if a man accuses his wife of adultery and both do not appear in court, the marriage will remain intact until he performs li'an (mutual cursing).
