بَابُ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثُمَّ يَقْذِفُهَا فِي عِدَّتِهَاChapter: A man divorces his wife, then accuses her during her waiting period
Hadith 2767

حَدَّثَنَا عَتَّابُ بْنُ بَشِيرٍ، أنا خُصَيفٌ، عَنْ عِكْرِمَةَ، عَنِ ابْنِ عَبَّاسٍ، فِي الرَّجُلِ يَقْذِفُ امْرَأَتَهُ ثُمَّ يَمُوتُ قَبْلَ أَنْ يُلَاعِنَهَا قَالَ: «يُوقَفُ فَإِنْ أَكْذَبَ نَفْسَهُ جُلِدَ الْحَدَّ وَوُرِّثَ وَإِنْ جَاءَ بِالشُّهُودِ وُرِّثَ، وَإِنَّ الْتَعَنَ لَمْ يُوَرَّثْ»
It is narrated from Sayyiduna Ibn Abbas (may Allah be pleased with them both) that whoever accused his wife of adultery and died before the process of li'an, he will be stopped; if he admits to lying, the prescribed punishment (hadd) will be carried out on him and he will inherit; if he brings witnesses, he will also inherit; and if he performs li'an, then there will be no inheritance.
