بَابُ الرَّجُلِ يُطَلِّقُ امْرَأَتَهُ ثُمَّ يَقْذِفُهَا فِي عِدَّتِهَاChapter: A man divorces his wife, then accuses her during her waiting period
Hadith 2756

حَدَّثَنَا هُشَيْمٌ، أنا مُغِيرَةُ، عَنِ الْحَارِثِ الْعُكْلِيِّ، فِي رَجُلٍ قَذَفَ امْرَأَتَهُ ثُمَّ اخْتَلَعَتْ مِنْهُ قَالَ: «هِيَ فَرَّتْ مِنَ الْمُلَاعَنَةِ فَلَا حَدَّ وَلَا لِعَانَ، وَإِذَا طَلَّقَهَا بَعْدَ قَذْفِهِ إِيَّاهَا فَهُوَ فَرَّ مِنَ الْمُلَاعَنَةِ فَضَرْبُ الْحَدِّ وَلَا لِعَانَ»
Hazrat Harith Akli (may Allah have mercy on him) said: If a woman takes khula after being accused of adultery (qadhf), then there is neither li'an nor hadd. And if divorce is given after qadhf, then hadd will be applied but there will be no li'an.
