Hadith 2755

حَدَّثَنَا هُشَيْمٌ، أنا إِسْمَاعِيلُ بْنُ أَبِي خَالِدٍ، عَنِ الشَّعْبِيِّ، أَنَّهُ سُئِلَ عَنْ رَجُلٍ، قَذَفَ امْرَأَتَهُ ثُمَّ اخْتَلَعَتْ مِنْهُ قَالَ: «إِنْ أَخَذَتْهُ بِالَقَذْفِ، فَمَا كَذَّبَ نَفْسَهُ؛ جُلِدَ، وَكَانَ لَهُ مَا أَخَذَ مِنْهَا، وَإِنْ لَاعَنَهَا رَدَّ عَلَيْهَا مَا أَخَذَ مِنْهَا»
It is narrated from Hazrat Sha'bi (may Allah have mercy on him) that if a person accused his wife of adultery, then she obtained khula (divorce), he said: If she took wealth on account of the accusation, then the hadd (punishment) will be applied and she will not return the wealth; if li'an (mutual cursing) was done, then she will return the wealth.
