Hadith 2746

حَدَّثَنَا سَعِيدٌ، نا هُشَيْمٌ، أنا هِشَامُ بْنُ حَسَّانَ، عَنْ حَيَّانَ الْأَزْدِيِّ، عَنْ جَابِرِ بْنِ زَيْدٍ، عَنْ ابْنِ عُمَرَ، أَنَّهُ قَالَ فِي رَجُلٍ طَلَّقَ امْرَأَتَهُ ثُمَّ قَذَفَهَا فِي الْعِدَّةِ قَالَ: " إِنْ كَانَ طَلَقَّهَا ثَلَاثًا جُلِدَ، وَأُلْحِقَ بِهِ الْوَلَدُ، وَلَمْ يُلَاعِنْ وَإِنْ طَلَّقَهَا وَاحِدَةً لَاعَنَهَا وَقَالَ ابْنُ عَبَّاسٍ: «إِنْ طَلَّقَهَا ثَلَاثًا ثُمَّ قَذَفَهَا فِي الْعِدَّةِ لَاعَنَهَا» وَقَالَ جَابِرُ بْنُ زَيْدٍ: قَوْلُ ابْنِ عُمَرَ أَحَبُّ إِلَيْنَا مِمَّا قَالَ ابْنُ عَبَّاسٍ.
Sayyiduna Ibn Umar (may Allah be pleased with them both) said: If someone divorces his wife and then accuses her during her waiting period, then if he has given three divorces, the prescribed punishment will be carried out and the child will be attributed to him. And if he has given one divorce, then li'an (mutual cursing) will be done. Jabir bin Zaid said: The statement of Ibn Umar is more preferable than that of Ibn Abbas.
