بَابُ الرَّجُلِ يُطَلِّقُ الْمَرْأَةَ تَطْلِيقَةً أَوْ تَطْلِيقَتَيْنِ ثُمَّ تَرْجِعُ إِلَيْهِ بَعْدَ زَوْجٍ عَلَى كَمْ تَكُونُ عِنْدَهُChapter: A man divorces his wife once or twice, then she returns to him after marrying another—how many times does she have left with him?

حَدَّثَنَا أَبُو عَوَانَةَ، عَنْ أَبِي بِشْرٍ، عَنْ مُعَاوِيَةَ بْنِ قُرَّةَ، أَنَّ زِيَادًا سَأَلَ عِمْرَانَ بْنَ حُصَيْنٍ عَنْ رَجُلٍ، طَلَّقَ امْرَأَتَهُ تَطْلِيقَتَيْنِ فَانْقَضَتْ عِدَّتُهَا فَتَزَوَّجَتْ رَجُلًا ثُمَّ تَزَوَّجَتِ الْأَوَّلَ قَالَ: «هِيَ عِنْدَهُ عَلَى وَاحِدَةٍ وَمَضَتْ ثِنْتَانِ وَبَقِيَتْ وَاحِدَةٌ» وَسَأَلَ شُرَيْحًا فَقَالَ: طَلَاقٌ جَدِيدٌ وَنِكَاحٌ جَدِيدٌ، فَقَالَ زِيَادٌ: قَدْ قَالَ شُرَيْحٌ وَقَضَى أَبُو نُجَيْدٍ
Sayyiduna Imran bin Husayn (may Allah be pleased with him) said that the wife will remain on one divorce. Shurayh said there will be a new marriage and a new divorce.
