حَدَّثَنَا عَتَّابُ بْنُ بَشِيرٍ، نا خُصَيْفٌ، عَنِ الْحَكَمِ، وَزِيَادِ بْنِ أَبِي مَرْيَمَ، قَالَا: «إِذَا طَلَّقَ الرَّجُلُ امْرَأَتَهُ طَلَاقًا بَائِنًا، وَقَدْ كَانَ دَخَلَ بِهَا فَتَزَوَّجَهَا فِي عِدَّتِهَا مِنَ الطَّلَاقِ، ثُمَّ طَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا كَانَ لَهَا الْمَهْرُ كَامِلًا، وَإِنْ تَزَوَّجَهَا بَعْدَ انْقِضَاءِ عِدَّتِهَا فَلَهَا نِصْفُ الْمَهْرِ»
Hazrat Hakam and Ziyad bin Abi Maryam (may Allah have mercy on them) said: If a man gives a woman an irrevocable divorce and marries her during her waiting period, then divorces her without seclusion, she will receive the full dowry. And if he marries her after the waiting period, she will receive half the dowry.
