حَدَّثَنَا سَعِيدٌ، نا حَمَّادُ بْنُ زَيْدٍ، عَنْ مَنْصُورٍ، عَنْ إِبْرَاهِيمَ فِي رَجُلٍ آلَى مِنِ امْرَأَتِهِ فَمَضَتْ أَرْبَعَةَ أَشْهُرٍ، أَوِ اخْتَلَعَتْ مِنْهُ فَتَزَوَّجَهَا فِي عِدَّتِهَا فَطَلَّقَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا قَالَ: كَانَ إِبْرَاهِيمُ يَقُولُ: " لَهَا الصَّدَاقُ تَامًّا وَيَسْتَقْبِلُ الْعِدَّةَ، وَكَانَ الْحَسَنُ وَعَامِرٌ يَقُولَانِ: لَهَا نِصْفُ الصَّدَاقِ وَتُكْمِلُ مَا بَقِيَ مِنْ عِدَّتِهَا، فَقُلْتُ لِمَنْصُورٍ: أَيُّ الْقَوْلَيْنِ أَحَبُّ إِلَيْكَ؟ قَالَ: قَوْلُ الْحَسَنِ وَعَامِرٍ "
A man made an oath of abstinence (ila) from his wife, four months passed or he divorced her through khul', then during her waiting period ('iddah) he married her again, but divorced her before seclusion (khalwah). Ibrahim (may Allah have mercy on him) said: She is entitled to the full dowry (mahr) and the waiting period ('iddah) will start anew. Hasan al-Basri and 'Amir (may Allah have mercy on them both) said: She will receive half the dowry and will complete the remaining waiting period. Mansur was asked: Which opinion do you prefer? He said: The opinion of Hasan and 'Amir.
