كتاب الطلاقBook of Divorce
وَقَالَ حَمَّادٌ: «لَيْسَ فِي مَالِهَا شَيْءٌ»And Hammad said: "There is nothing from her wealth."
Hadith 2624

حَدَّثَنَا أَبُو مُعَاوِيَةَ، نا هِشَامُ بْنُ عُرْوَةَ، قَالَ: خَلَعَ جُمْهَانَ الْأَسْلَمِيَّ امْرَأَتُهُ ثُمَّ نَدِمَ وَنَدِمَتْ، فَأَتَيَا عُثْمَانَ بْنَ عَفَّانَ، فَذَكَرَا ذَلِكَ لَهُ، فَقَالَ: " هِيَ تَطْلِيقَةٌ إِلَّا أَنْ تَكُونَ سَمَّيَتْ شَيْئًا فَهُوَ عَلَى مَا سَمَّيَتْ، فَكَانَ أَبِي يَقُولُ: الْخُلْعُ تَطْلِيقَةٌ بَائِنَةٌ، وَتَعْتَدُّ ثَلَاثَ حِيَضٍ، وَصَاحِبُهَا أَوْلَى بِالْخِطْبَةِ فِي الْعِدَّةِ "
Jumhan Aslami gave his wife khul‘ (divorce by mutual consent), then both expressed regret. They came to Sayyiduna Uthman bin Affan (may Allah be pleased with him), so he said: This is an irrevocable divorce, unless something specific has been stipulated. Hisham says: My father used to say: Khul‘ is an irrevocable divorce, and the woman will observe the waiting period of three menstrual cycles, and during the waiting period, the same husband has the most right to remarry her.
