بَابُ مَا جَاءَ فِي نَفَقَةِ الْحَامِلِChapter: What is reported regarding the maintenance of a pregnant woman
Hadith 2553

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا سَيَّارٌ، عَنِ الشَّعْبِيِّ، قَالَ: " أَرْسَلَ إِلَيَّ يَزِيدُ بْنُ أَبِي مُسْلِمٍ يَسْأَلُنِي عَنِ الْمُتَوَفَّى عَنْهَا وَهِيَ حَامِلٌ، فَقُلْتُ لَهُ: يُنْفَقُ عَلَيْهَا مِنْ جَمِيعِ الْمَالِ حَتَّى تَضَعَ، فَإِذَا وَضَعَتْ قُسِمَ الْمِيرَاثُ. فَقَالَ لِي يَزِيدُ: نَقْسِمُ الْمِيرَاثَ، فَنَعْزِلُ لِمَا فِي بَطْنِهَا نَصِيبَ الْغُلَامِ، فَإِنْ جَاءَتْ بِغُلَامٍ فَلَهُ نَصِيبُهُ، وَإِنْ جَاءَتْ بِجَارِيَةٍ أُعْطِيَتْ نَصِيبَهَا وَقُسِمَ مَا سِوَى ذَلِكَ بَيْنَ الْوَرَثَةِ؟ فَقُلْتُ: أَرَأَيْتَ إِنْ جَاءَتْ بِهِمَا تَوْأَمَاتٍ؟ فَإِنِّي أَنَا وَعَمْرَةَ - قُلْتُ: وَهِيَ أُخْتُ الشَّعْبِيِّ - وُلِدْنَا فِي بَطْنٍ "
Hazrat Sha'bi (may Allah have mercy on him) says: Yazid bin Abi Muslim asked me about a pregnant widow, so I said: All the wealth will be spent on her until the child is born. Then Yazid said: We will distribute the inheritance and allocate the share of a boy for the child in her womb; if it is a boy, we will give him his share, if it is a girl, we will give her share, and the rest of the inheritance will be distributed. I said: What if twins are born? Because my sister Amrah (may Allah have mercy on both of us) and I were born from the same womb.
