قَوْلُهُ تَعَالَى: {كُتِبَ عَلَيْكُمْ إِذَا حَضَرَ أَحَدَكُمُ الْمَوْتُ إِنْ تَرَكَ خَيْرًا الْوَصِيَّةُ لِلْوَالِدَيْنِ وَالأَقْرَبِينَ بِالْمَعْرُوفِ حَقًّا عَلَى الْمُتَّقِينَ}His saying, Exalted is He: {Prescribed for you when death approaches [any] one of you if he leaves wealth is that he should make a bequest for the parents and near relatives according to what is acceptable—a duty upon the righteous.}
Hadith 253

حَدَّثَنَا سَعِيدٌ قَالَ: نَا سُفْيَانُ، عَنِ ابْنِ طَاوُسٍ، عَنْ أَبِيهِ، أَنَّهُ كَانَ يَقُولُ: إِنَّ الْوَصِيَّةَ كَانَتْ قَبْلَ الْمِيرَاثِ، فَلَمَّا نَزَلَ الْمِيرَاثُ نَسَخَ الْمِيرَاثُ مَنْ يَرِثُ، وَبَقِيَتِ الْوَصِيَّةُ لِمَنْ لَا يَرِثُ، فَهِيَ ثَابِتَةٌ، فَمَنْ أَوْصَى لِغَيْرِ ذِي قَرَابَةٍ لَمْ تَجُزْ وَصِيَّتُهُ ؛ لِأَنَّ رَسُولَ اللهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ قَالَ: لَا تَجُوزُ لِوَارِثٍ وَصِيَّةٌ .
Tawoos (may Allah have mercy on him) used to say: The command of bequest (wasiyyah) was before inheritance, then when the command of inheritance was revealed, bequest for heirs was abrogated, and those who are not heirs remained entitled to bequest, so this (ruling) remains. Therefore, if a person makes a bequest for someone who is not a close relative, his bequest is not permissible; because the Messenger of Allah (peace and blessings be upon him) said: "Bequest is not permissible for an heir."
