بَابُ الطَّلَاقِ بِالرِّجَالِ وَالْعِدَّةِ بِالنِّسَاءِChapter: Divorce is for men and waiting period is for women
Hadith 2508

حَدَّثَنَا سَعِيدٌ قَالَ: نا عَبْدُ الْعَزِيزِ بْنُ مُحَمَّدٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ: «يُطَلِّقُ الْحُرُّ الْأَمَةَ ثَلَاثَ تَطْلِيقَاتٍ، وَتَعْتَدُّ حَيْضَتَيْنِ، وَيُطَلِّقُ الْمَمْلُوكُ الْحُرَّةُ تَطْلِيقَتَيْنِ، وَتَعْتَدُّ ثَلَاثَ حِيَضٍ، فَالثَّلَاثُ بِالرِّجَالِ، وَالْعِدَّةُ بِالنِّسَاءِ»
It is narrated from Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him) that he said: A free man can give three divorces to a slave woman and her waiting period ('iddah) is two menstrual cycles; a slave can give two divorces to a free woman and her waiting period is three menstrual cycles. Thus, divorce is with the men and the waiting period is with the women.
