بَابُ مَنْ رَاجِعَ امْرَأَتَهُ وَهُوَ غَائِبٌ وَهِيَ لَا تَعْلَمُChapter: One who takes back his wife while absent and she does not know
Hadith 2498

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا دَاوُدُ، عَنِ الشَّعْبِيِّ، أَنَّ رَجُلًا طَلَّقَ امْرَأَتَهُ تَطْلِيقَةً فَأَعْلَمَهَا بِالطَّلَاقِ، ثُمَّ سَافَرَ وَكَتَبَ إِلَيْهَا بِالرَّجْعَةِ فَلَمْ يَبْلُغْهَا الْكِتَابُ، حَتَّى انْقَضَتِ الْعِدَّةُ، فَأَتَى شُرَيْحًا فَذَكَرَ ذَلِكَ لَهُ، فَقَالَ شُرَيْحٌ: «إِنْ كَانَتْ تَزَوَّجَتْ فَلَا سَبِيلَ لَكَ عَلَيْهَا، وَإِنْ كَانَتْ لَمْ تَتَزَوَّجْ فَارْفَعْهَا إِلَى السُّلْطَانِ، فَيَكُونُونَ هُمُ الَّذِينَ يَرُدُّونَهَا عَلَيْكَ أَوْ يَمْنَعُونَكَهَا، وَأَعْلِمُوهُنَّ الرَّجْعَةَ كَمَا تُعْلِمُونَهُنَّ الطَّلَاقَ»
A man divorced his wife and informed her, then went on a journey and wrote a letter of reconciliation, which arrived after the waiting period had ended. So Shurayh (may Allah have mercy on him) said: If she has married (someone else), then you have no right; if she has not married, then take the matter to the ruler, he will decide. And informing about reconciliation is just as necessary as informing about divorce.
