بَابُ مَنْ رَاجِعَ امْرَأَتَهُ وَهُوَ غَائِبٌ وَهِيَ لَا تَعْلَمُChapter: One who takes back his wife while absent and she does not know
Hadith 2497

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، وَشُعْبَةَ، عَنِ الْحَكَمِ، عَنْ عَلِيٍّ، رَضِيَ اللَّهُ عَنْهُ أَنَّهُ كَانَ يَقُولُ: «إِذَا رَاجَعَهَا فِي الْعِدَّةِ فَهِيَ امْرَأَتُهُ، تَزَوَّجَتْ أَوْ لَمْ تَتَزَوَّجْ، دَخَلَ بِهَا أَوْ لَمْ يَدْخُلْ بِهَا، عَلِمَتْ أَوْ لَمْ تَعْلَمْ»
It is narrated from Sayyiduna Ali (may Allah be pleased with him) that he said: If the husband takes his wife back during the waiting period (‘iddah), then the woman will belong to him, whether he marries her again or not, whether consummation takes place or not, whether she knows about it or not.
