بَابُ مَنْ رَاجِعَ امْرَأَتَهُ وَهُوَ غَائِبٌ وَهِيَ لَا تَعْلَمُChapter: One who takes back his wife while absent and she does not know
Hadith 2496

حَدَّثَنَا سَعِيدٌ قَالَ: نا عَتَّابٌ، قَالَ: أنا خُصَيْفٌ، عَنْ سَعِيدِ بْنِ الْمُسَيِّبِ، قَالَ فِي الرَّجُلِ الْغَائِبِ يَكْتُبُ إِلَى امْرَأَتِهِ بِالطَّلَاقِ، ثُمَّ يَكْتُبُ إِلَيْهَا بِالرَّجْعَةِ، فَلَا يَأْتِيهَا حَتَّى تَتَزَوَّجَ، قَالَ: «إِذَا أَدْرَكَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا الْآخَرُ فَهِيَ امْرَأَتُهُ، وَإِنْ لَمْ يُدْرِكْهَا حَتَّى يَدْخُلَ بِهَا فَقَدْ بَانَتْ»
It is narrated from Hazrat Sa'id bin al-Musayyib (may Allah have mercy on him) that he said: If a husband divorces (his wife) through a letter, then takes her back (revokes the divorce), but the letter of revocation does not reach the wife and she marries another man, if the (first) husband reaches her before consummation (with the second husband), then the wife will remain his; otherwise, she will not.
