بَابُ مَنْ رَاجِعَ امْرَأَتَهُ وَهُوَ غَائِبٌ وَهِيَ لَا تَعْلَمُChapter: One who takes back his wife while absent and she does not know
Hadith 2493

حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو مُعَاوِيَةَ، قَالَ: نا الْأَعْمَشُ، عَنْ إِبْرَاهِيمَ، أَنَّ أَبَا كَنَفٍ طَلَّقَ امْرَأَتَهُ وَهُوَ غَائِبٌ فَأَعْلَمَهَا الطَّلَاقَ، ثُمَّ رَاجَعَهَا وَلَمْ يُعْلِمْهَا بِالرَّجْعَةِ، فَقَدِمَ أَبُو كَنَفٍ، فَإِذَا هِيَ قَدْ تَزَوَّجَتْ، فَأَتَى عُمَرَ بْنَ الْخَطَّابِ فَذَكَرَ ذَلِكَ لَهُ، فَقَالَ عُمَرُ: " النَّجَاءَ، فَإِنْ أَدْرَكْتَهَا قَبْلَ أَنْ يَدْخُلَ بِهَا فَهِيَ امْرَأَتُكَ، وَإِنْ جِئْتَ بَعْدَ مَا يَدْخُلُ بِهَا فَلَا سَبِيلَ عَلَيْهَا. فَجَاءَ فَوَافَقَهَا لَيْلَةَ عُرْسِهَا، فَقَالَ: اسْتَأْذِنُوا لِي عَلَيْهَا؛ فَإِنَّ لِي إِلَيْهَا حَاجَةً. فَفَعَلُوا، فَأَخَذَ بِرِجْلِهَا "
It is narrated from Sayyiduna Umar (may Allah be pleased with him) that if a man revokes the divorce after pronouncing it but does not inform his wife, then if the second husband has not consummated the marriage, the first husband has more right to her. However, if consummation has taken place, then the first husband no longer has any right.
