بَابُ الْأَمَةِ تُطَلَّقُ فَتُعْتَقُ فِي الْعِدَّةِChapter: A slave woman is divorced and freed during her waiting period
Hadith 2456

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مُغِيرَةُ، عَنْ إِبْرَاهِيمَ، وَيُونُسَ، عَنِ الْحَسَنِ، وَمُحَمَّدِ بْنِ سَالِمٍ، عَنِ الشَّعْبِيِّ، أَنَّهُمْ قَالُوا فِي عِدَّةِ الْأَمَةِ إِذَا طُلِّقَتْ: " إِنْ كَانَتْ تَحِيضُ فَحَيْضَتَانِ، وَإِنْ كَانَتْ لَا تَحِيضُ فَشَهْرٌ وَنِصْفٌ، وَإِنْ تُوُفِّيَ عَنْهَا فَشَهْرَانِ وَخَمْسَةُ أَيَّامٍ، قَالَ هُشَيْمٌ: وَهُوَ الْقَوْلُ "
Ibrahim Nakha'i, Hasan Basri, and Sha'bi (may Allah have mercy on them) say: The waiting period ('iddah) for a slave woman, if she menstruates, is two menstrual cycles. If she does not menstruate, then one and a half months. And if her husband dies, then two months and five days.
