بَابُ الْأَمَةِ تُطَلَّقُ فَتُعْتَقُ فِي الْعِدَّةِChapter: A slave woman is divorced and freed during her waiting period
Hadith 2446

حَدَّثَنَا سَعِيدٌ قَالَ: نا عَتَّابُ بْنُ بَشِيرٍ، قَالَ: أنا خُصَيْفٌ، عَنْ مُجَاهِدٍ فِي الْأَمَةِ تُطَلَّقُ ثُمَّ تُعْتَقُ وَهِيَ فِي الْعِدَّةِ، قَالَ: «تَسْتَأْنِفُ عِدَّةَ الْحُرَّةِ إِذَا كَانَتْ مِنْ تَطْلِيقَةٍ، وَإِنْ كَانَتْ مِنْ تَطْلِيقَتَيْنِ فَقَدْ بَانَتْ تَعْتَدُّ ثَلَاثَةَ قُرُوءٍ»
Hazrat Mujahid (may Allah have mercy on him) says: If a slave woman is divorced and she is freed during her waiting period (‘iddah), then if the divorce is one, she will observe the waiting period of a free woman. If there are two divorces, then there will be no return (ruju‘), and she will observe the waiting period of a free woman.
