بَابُ مَا جَاءَ فِي خِيَارِ الْأَمَةِChapter: What is reported regarding the choice of a slave woman
Hadith 2439

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا حُصَيْنٌ، عَنِ الشَّعْبِيِّ، قَالَ: كَانَ فِي بَرِيرَةَ ثَلَاثُ قَضِيَّاتٍ: جَعَلَ لَهَا رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ الْخِيَارَ عَلَى زَوْجِهَا، وَكَانَ مَوَالِيهَا بَاعُوهَا مِنْ عَائِشَةَ وَاشْتَرَطُوا أَنَّ الْوَلَاءَ لَهُمْ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «الْوَلَاءُ لِمَنْ أَعْتَقَ»، وَتُصُدِّقَ عَلَيْهَا بِلَحْمٍ فَأَهْدَتْهُ إِلَى عَائِشَةَ، فَدَخَلَ النَّبِيُّ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ فَأَرَادَ أَنْ يَأْكُلَ مِنْهُ، فَقَالَتْ: إِنَّهُ تُصُدِّقَ عَلَى بَرِيرَةَ، فَقَالَ رَسُولُ اللَّهِ صَلَّى اللهُ عَلَيْهِ وَسَلَّمَ: «هُوَ عَلَى بَرِيرَةَ صَدَقَةٌ، وَهُوَ لَنَا هَدِيَّةٌ»
Al-Sha'bi (may Allah have mercy on him) said: Three rulings were made regarding Barirah: The Messenger of Allah (peace and blessings be upon him) gave her the choice regarding her husband. Her masters stipulated the condition of wala', so the Prophet (peace and blessings be upon him) said: "Wala' belongs to the one who sets free." Meat that had been given as charity to Barirah was gifted to Lady Aisha (may Allah be pleased with her), so the Prophet (peace and blessings be upon him) said: "It was charity for her, and it is a gift for us."
