بَابُ مَا جَاءَ فِي خِيَارِ الْأَمَةِChapter: What is reported regarding the choice of a slave woman
Hadith 2428

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا مَنْصُورٌ، وَيُونُسُ، عَنِ الْحَسَنِ «أَنَّهُ كَانَ يَقُولُ فِي الْأَمَةِ إِذَا أُعْتِقَتْ وَلَهَا زَوْجٌ حُرٌّ فَلَا خِيَارَ لَهَا، وَإِنْ كَانَ عَبْدًا فَلَهَا الْخِيَارُ»
If the slave woman is freed and the husband is free, then there is no choice; if the husband is a slave, then there is a choice.
