بَابُ مَا جَاءَ فِي خِيَارِ الْأَمَةِChapter: What is reported regarding the choice of a slave woman
Hadith 2427

حَدَّثَنَا سَعِيدٌ قَالَ: نا سُفْيَانُ، عَنِ الزُّهْرِيِّ، عَنْ سَالِمٍ، عَنْ أَمَةٍ لِبَنِي عَدِيِّ بْنِ كَعْبٍ أُعْتِقَتْ وَلَهَا زَوْجٌ، فَقَالَتْ لَهَا حَفْصَةُ: «إِنِّي مُخْبِرَتُكِ وَمَا أُحِبُّ أَنْ تَفْعَلِيهِ، لَكِ الْخِيَارُ مَا لَمْ يَمَسَّكِ زَوْجُكِ، فَإِذَا مَسَّكِ فَلَا خِيَارَ لَكِ»، قَالَتْ: فَاشْهَدِي أَنِّي قَدْ فَارَقْتُهُ ثُمَّ فَارَقْتُهُ
Sayyida Hafsa (may Allah be pleased with her) said to a slave woman of Banu Adi: "You have the choice as long as your husband has not had intercourse with you." So the slave woman separated (from him).
