كتاب الطلاقBook of Divorce
بَابُ مَنْ قَالَ لِامْرَأَتِهِ: أَنْتِ طَالِقٌ إِذَا شِئْتِChapter: One who says to his wife, "You are divorced if you wish"
Hadith 2421

حَدَّثَنَا سَعِيدٌ قَالَ: نا إِسْمَاعِيلُ بْنُ عَيَّاشٍ، عَنْ عُبَيْدِ اللَّهِ بْنِ عُبَيْدٍ الْكَلَاعِيِّ، عَنْ مَكْحُولٍ فِي مَمْلُوكٍ نَكَحَ الْوَلِيدَةَ فَأُعْتِقَتْ قَبْلَ أَنْ يَدْخُلَ بِهَا وَقَدْ أَعْطَاهَا صَدَاقَهَا، فَخُيِّرَتْ فَاخْتَارَتْ نَفْسَهَا، قَالَ: «يُرَدُّ إِلَيْهِ مَا أَعْطَاهَا»
If a slave marries a slave woman, and before consummation she is set free and then chooses herself, the dowry given to the husband will be returned.
