كتاب الطلاقBook of Divorce
بَابُ الرَّجُلِ لَهُ أَرْبَعُ نِسْوَةٍ فَنَهَى وَاحِدَةً عَنِ الْخُرُوجِ، فَوَجَدَ امْرَأَةً مِنْ نِسَائِهِ قَدْ خَرَجَتْ، فَقَالَ: فُلَانَةُ أَنْتِ طَالِقٌ، أَيَّتُهُنَّ تُطَلَّقُ مِنْهُ؟Chapter: A man has four wives, forbids one from going out, finds one of his wives has gone out, and says, "So-and-so, you are divorced"—which one is divorced?
Hadith 2359

حَدَّثَنَا سَعِيدٌ قَالَ: نا أَبُو عَلْقَمَةَ الْفَرْوِيُّ، قَالَ: حَدَّثَنِي إِسْحَاقُ بْنُ عَبْدِ اللَّهِ بْنِ أَبِي فَرْوَةَ، قَالَ: كَانَ عُثْمَانُ بْنُ عَفَّانَ رَضِيَ اللَّهُ عَنْهُ يَقُولُ: «لَيْسَ الطَّلَاقُ عَلَى مَا أَضْمَرْتَ، وَلَكِنِ الطَّلَاقُ عَلَى مَا خَرَجَ مِنْ فِيكَ»
Sayyiduna Uthman bin Affan (may Allah be pleased with him) said: Divorce is not based on a hidden intention in the heart, but rather on the words uttered by the tongue.
