كتاب الطلاقBook of Divorce
بَابُ الرَّجُلِ لَهُ أَرْبَعُ نِسْوَةٍ فَنَهَى وَاحِدَةً عَنِ الْخُرُوجِ، فَوَجَدَ امْرَأَةً مِنْ نِسَائِهِ قَدْ خَرَجَتْ، فَقَالَ: فُلَانَةُ أَنْتِ طَالِقٌ، أَيَّتُهُنَّ تُطَلَّقُ مِنْهُ؟Chapter: A man has four wives, forbids one from going out, finds one of his wives has gone out, and says, "So-and-so, you are divorced"—which one is divorced?
Hadith 2357

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا ابْنُ شُبْرُمَةَ، عَنِ الشَّعْبِيِّ، قَالَ: «النِّيَّةُ فِي الطَّلَاقِ فِيمَا خَفِيَ، وَأَمَّا مَا ظَهَرَ فَلَا نِيَّةَ فِيهِ»
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: In divorce, intention is considered in hidden matters; in apparent matters, intention is not considered.
