كتاب الطلاقBook of Divorce
بَابُ الرَّجُلِ لَهُ أَرْبَعُ نِسْوَةٍ فَنَهَى وَاحِدَةً عَنِ الْخُرُوجِ، فَوَجَدَ امْرَأَةً مِنْ نِسَائِهِ قَدْ خَرَجَتْ، فَقَالَ: فُلَانَةُ أَنْتِ طَالِقٌ، أَيَّتُهُنَّ تُطَلَّقُ مِنْهُ؟Chapter: A man has four wives, forbids one from going out, finds one of his wives has gone out, and says, "So-and-so, you are divorced"—which one is divorced?
Hadith 2353

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: أنا يُونُسُ، عَنِ الْحَسَنِ فِي رَجُلٍ لَهُ امْرَأَتَانِ نَهَى إِحْدَاهُمَا عَنِ الْخُرُوجِ، فَخَرَجْتِ الَّتِي لَمْ تُنْهَ، فَظَنَّ أَنَّهَا الَّتِي نَهَى فَقَالَ: فُلَانَةُ، أَخَرَجْتِ؟ أَنْتِ طَالِقٌ، قَالَ: «تُطَلَّقُ الَّتِي نَوَى، أَوْ أَرَادَ» قَالَ هُشَيْمٌ: وَهُوَ الْقَوْلُ
Hasan al-Basri (may Allah have mercy on him) said: If a man has two wives, forbids one from going out, and the other goes out, and he mistakenly thinks it is the forbidden wife and says: "Did you go out? Then you are divorced," then the divorce will apply to the one he intended.
