Hadith 2335

حَدَّثَنَا سَعِيدٌ قَالَ: نا هُشَيْمٌ، قَالَ: نا يُونُسُ، عَنِ الْحَسَنِ، وَمُحَمَّدُ بْنُ سَالِمٍ، عَنِ الشَّعْبِيِّ، أَنَّهُمَا قَالَا فِي رَجُلٍ قَالَ لِامْرَأَتِهِ: الْحَقِي بِأَهْلِكِ، وَلَا سَبِيلَ لِي عَلَيْكِ، وَالطَّرِيقُ لَكِ وَاسِعٌ، قَالَا: «إِنْ كَانَ نَوَى الطَّلَاقَ فَهِيَ وَاحِدَةٌ وَهُوَ أَحَقُّ بِهَا، وَإِنْ لَمْ يَنْوِ طَلَاقًا فَلَيْسَ بِشَيْءٍ»
Hasan al-Basri and 'Amir al-Sha'bi, may Allah have mercy on them, said: Whoever says to his wife: "Go to your (own) house," or says, "I have no right over you," or "The way is open for you," if he intends divorce, then it is one divorce, and the husband has more right to his wife. And if he does not intend (divorce), then there is nothing (i.e., it does not count as divorce).
