بَابُ الرَّجُلِ يَحْلِفُ إِنْ لَمْ يَضْرِبْ غُلَامَهُ مِائَةَ سَوْطٍ فَامْرَأَتُهُ طَالِقٌChapter: A man swears that unless he beats his slave a hundred lashes, his wife is divorced
Hadith 2328

حَدَّثَنَا سَعِيدٌ قَالَ: نا خَالِدُ بْنُ عَبْدِ اللَّهِ، عَنْ صَالِحِ بْنِ مُسْلِمٍ، عَنِ الشَّعْبِيِّ، فِي رَجُلٍ قَالَ لِغُلَامِهِ: إِنْ لَمْ أَضْرِبْهُ فَامْرَأَتُهُ طَالِقٌ فَأَبَقَ الْغُلَامُ، فَقَالَ: «هِيَ امْرَأَتُهُ حَتَّى يَمُوتَ الْغُلَامُ» . قَالَ سَعِيدٌ: بِئْسَ مَا قَالَ
Hazrat Aamir Sha'bi (may Allah have mercy on him) said: If a slave runs away and the husband says that his wife is divorced until he beats (the slave), then his wife will remain with him until the slave dies.
